On most restoration jobs, the outcome of the claim is shaped long before the first air mover starts running. It is often shaped at the kitchen table on day one, by the paperwork the homeowner signs. The work authorization is easy to treat as a formality, a signature you collect so you can get to work. In reality, it is one of the most important documents in the entire claim, and the difference between a strong one and a weak one often shows up months later, when it is time to get paid.
As carrier review becomes more procedural, the documents signed before work begins can determine whether a contractor has leverage later.
Here is what a strong work authorization actually contains, and why each piece matters.
A well-built work authorization is more than a single signature page. It often combines several separate legal tools, each doing a different job:
Because these provisions may be governed by different contract, insurance, consumer-protection, and lien laws, treating the work authorization as “just one form” is exactly how gaps slip in.
Of all these tools, the assignment of benefits carries the most weight. With a valid AOB in place, the contractor has a stronger basis to seek direct payment and enforce assigned post-loss rights, depending on state law and policy language. Without one, the carrier may pay the policyholder, leaving the contractor to collect from the homeowner after the fact.
That is not a rare scenario. Across our platform, roughly one in five carrier payments has historically been issued directly to the property owner rather than the contractor or their billing partner. Exact figures are generalized, and payment routing varies by carrier and state. When that happens, recovering the funds takes extra steps, adds weeks, and occasionally does not fully happen at all.
It is also worth understanding why an AOB is stronger than a direction to pay, because the two are often confused. A direction to pay generally instructs the carrier; it does not necessarily bind them, and they may still issue the check to the insured. An AOB actually transfers certain underlying post-loss rights. A carefully drafted AOB may assign more than the right to receive payment. In some states and circumstances, it may also affect who has standing to pursue claim remedies such as appraisal. That distinction can matter a great deal when a file becomes contested.
The less glamorous clauses earn their keep too. A limited power of attorney to endorse checks is essential, but it has limits worth knowing: when a carrier check names more than one payee, such as a coinsured spouse or a mortgage company, every named payee has to endorse it. A power of attorney from the insured alone cannot sign for the others.
Preserving lien rights, including any required pre-lien notice, keeps a last-resort collection tool available if everything else fails. Because lien deadlines are strict and state-specific, that clause has to be in place at the start, not added when a problem appears.
Many contractors run on a generic work authorization downloaded years ago or inherited from another company. The most common gaps we see are a missing AOB, or only a weak direction to pay; no provision for endorsing checks; no reservation of lien rights; and language that has never been tested against real carrier pushback, payment-routing problems, or escalation disputes.
None of these show up as a problem on a smooth claim. They show up on the difficult ones, which are exactly the files where you need every tool working.
This is general information, not legal advice. Assignment rules, anti-assignment rules or AOB restrictions, lien deadlines, and the line between billing or advocating for your own assigned work and engaging in regulated public-adjusting activity all vary meaningfully from state to state. A work authorization that is fully enforceable in one state may not hold up the same way in another. Contractors should have their work authorization and payment-handling process reviewed by qualified counsel in each state where they operate.
The work authorization is the foundation the entire claim rests on. Get it right up front and many of the hardest collection problems never get the chance to start. Get it wrong, and no amount of documentation or negotiation later can fully make up for it.

It is a small change that protects every claim that comes after it.
